1. General Information About the Terms of Use
Welcome, and thank you for your interest in Illustrative Mathematics (“Illustrative Mathematics,” “IM,” “we,” “our,” or “us”). Unless otherwise noted on a particular website or service, these central terms and conditions of use (“Central Terms” or “Terms”) apply to your use of all of the websites that the nonprofit corporation Illustrative Mathematics operates. These include https://illustrativemathematics.org, https://accessim.org, https://im.kendallhunt.com, together with all other subdomains thereof, (collectively, the “Websites”). The Terms also apply to all products, information, curriculum, and services provided through the Websites.
Additional terms: In addition to the Terms of Use, your use of any services may also be subject to specific terms applicable to a particular service (“Additional Terms”). If there is any conflict between the Additional Terms and these Central Terms, then the Additional Terms apply in relation to the relevant service.
Collectively, the Terms: the Central Terms of Use, together with any Additional Terms, form a binding legal agreement between you and Illustrative Mathematics in relation to your use of the Websites and Services.
2. Acceptance of Terms
These Terms and conditions outline the rules and regulations for use of ILLUSTRATIVE MATHEMATICS’ Websites. By accessing or using any of the Websites operated by Illustrative Mathematics, we assume you accept these Terms and Conditions of Use in full. Do not continue to use IM’s Websites if you do not accept all of the Terms and conditions stated on this page.
These Terms apply to all visitors, users, teachers, students, parents, and others who access or use the Websites. Your continued use of any of the IM Websites following the posting of any changes to these Terms constitutes acceptance of those changes.
3. About Illustrative Mathematics
Illustrative Mathematics (IM) is a nonprofit organization incorporated in the State of Arizona and exempt from federal income tax under Section 501(c)(3) of the Internal Revenue Code. IM develops and freely distributes high-quality mathematics curricula and educational resources.
Illustrative Mathematics is the author of IM® K–12 Math, IM® TK–12 Math v.360 and other curricula (the “Curriculum”), and the owner of United States registered trademarks Illustrative Mathematics®, IM®, IM Illustrative Mathematics Certified®, and the IM logo mark (U.S. Reg. Nos. 90021061, 97412460, 88330436, and 97412527) (the “Trademarks”). ALL RIGHTS RESERVED.

4. Modifications to These Terms
IM reserves the right to revise these Terms at any time at its sole discretion. We will notify users of material changes by updating the Effective Date at the top of this page and, where appropriate, by posting a notice on the Websites. Your continued use of the Websites after any changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
5. Privacy Policy
5.1 Privacy Policies
IM is committed to protecting your privacy. The collection, use, and storage of personal information submitted through the Websites is governed by our separate Privacy Policy, which is incorporated into these Terms by reference. By using the Websites, you consent to the data practices described in our Privacy Policy. Please note that certain products or services made available by us, other than the Websites, may be subject to different privacy policies. In addition, the Websites’ Privacy Policies do not address, and we are not responsible or liable for, the information collection, usage, and disclosures practices of any third party or third party service.
5.2 General Use
The Websites are open to the general public. Student-facing curriculum content may be accessed by users of all ages without registration or login credentials. IM does not collect personal information from students accessing curriculum content without login. The illustrativemathematics.org website does not collect student information.
5.3 Teacher Registration and Restricted Content
Certain teacher-facing materials on the curriculum websites require registration and login. By registering for an account, you represent that you are at least 18 years of age or are accessing the site under the supervision of a parent or guardian, and that all information you provide during registration is accurate and complete.
5.4 Children Under 13
IM does not knowingly collect personal information from children under the age of 13. Student content accessible without login is designed for use in classroom settings under adult supervision. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at [email protected] and we will take steps to investigate and delete any such information.
6. Intellectual Property
Except as expressly stated in these Terms or in a separate written license agreement, IM reserves all rights in and to its intellectual property. No license or right is granted by implication, estoppel, or otherwise. Any unauthorized reproduction, redistribution, modification, or commercial exploitation of IM’s content outside of the License Terms is strictly prohibited and may result in civil or criminal liability.
7. License
7.1 Curriculum License: IM® K–12 Math | CC BY 4.0
The first edition of IM K–12 Math curriculum (© 2019 – 2021) is freely accessible by teachers, students, and families as an Open Education Resource at http://im.kendallhunt.com and is licensed for use under the Creative Commons Attribution 4.0 International License (CC BY 4.0). Under the license, users are free to share and adapt the materials for any purpose, including commercially, with appropriate attribution to the author, Illustrative Mathematics, hyperlink to the license, and indication if changes were made.
A suggested attribution is as follows: “Based on IM® K–12 Math authored by Illustrative Mathematics and licensed under CC BY 4.0.” See Creative Commons for more information on the conditions license use.
7.2 Curriculum License: IM® TK–12 Math v.360 | CC BY-NC
The second edition of IM K–12 Math, called IM TK–12 Math v.360 (“IM v.360”) (© 2024 and IM TK Math © 2025) curriculum is freely accessible at accessim.org by teachers, students, and families as an Open Education Resource and is licensed under the Creative Commons Attribution-NonCommercial 4.0 International License (CC BY-NC 4.0). The Creative Commons license governs the IM v.360 curriculum only and not other IM Products or content hosted at accessim.org. Under the license, users are free to share and adapt the materials for non-commercial purposes, with appropriate attribution to the author, Illustrative Mathematics, hyperlink to the license, and indication if changes were made.
A suggested attribution is as follows: “Based on IM® TK–12 Math v.360 authored by Illustrative Mathematics and licensed under CC BY-NC 4.0.” See Creative Commons for more information on the conditions of license use.
Commercial use of the IM v.360 curriculum materials and name, including but not limited to incorporation into paid products or services or the name used for promotional purposes of third party products or services, is prohibited without prior written permission from Illustrative Mathematics. By downloading or linking to IM v.360 materials from the www.accessim.org website, you agree that you will make only non-commercial uses of the materials, and that you will reproduce and distribute these materials only for non-commercial use in the classroom or within third party resources or services. Commercial uses, and reproduction and distributions made for other than non-commercial use, are expressly prohibited. 7.3 IM Brand Use and Licensing
Use of the Illustrative Mathematics name, brand, associated trademarks, or curriculum content beyond the scope of the applicable Creative Commons license requires express written permission from IM. Unauthorized commercial use or brand co-option is a violation of these Terms and may infringe IM’s intellectual property rights. The Illustrative Mathematics® company name and associated trademarks (“IM®” and “IM Illustrative Mathematics Certified®”) are not subject to use with Creative Commons licenses.
8. Hyperlinking to Our Content
8.1 Permitted Links
The following organizations may link to the IM Websites without prior written permission:
- Government agencies
- Search engines
- News organizations
- Online directory distributors when listing IM in a directory of nonprofits
- Accredited educational institutions and system-wide accredited businesses
These organizations may link to our homepage, publications, or other website information, provided such links: (a) are not in any way deceptive; (b) do not falsely imply sponsorship, endorsement, or approval of the linking party or its products and services; and (c) fit within the context of the linking party’s site.
8.2 Requests for Linking
Other organizations wishing to link to any IM website must submit a written request to [email protected]. We will evaluate link requests on a case-by-case basis. We reserve the right to approve or reject any link request at our sole discretion and to request the removal of any link at any time.
8.3 Framing
No organization may frame any IM website or create a browser or border environment around any IM content without express written consent. IM reserves the right to withdraw linking permission at any time without notice.
9. User Conduct and Prohibited Uses
By using the Websites, you agree not to:
- Use the Websites for any unlawful purpose or in violation of any applicable regulations
- Attempt to gain unauthorized access to any part of the Websites or to any systems or networks connected to the Websites
- Upload, transmit, or distribute any content that infringes the intellectual property rights of IM or any third party
- Reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Websites or their content for commercial purposes without IM’s express written permission
- Use automated tools (bots, scrapers, crawlers) to access the Websites in a manner that places excessive load on servers or circumvents technical access controls
- Impersonate IM, its staff, or any other person or entity
- Post or transmit any unsolicited advertising, promotional materials, or spam
10. The IM Swag Shop
10.1 Shop Overview
IM operates an online store (“Swag Shop”) offering branded merchandise. To make a purchase, users must create an account and provide accurate billing and shipping information. All sales through the Swag Shop are subject to these Terms and to any additional Terms posted within the store.
10.2 Purchases & Payment Processing
All purchases through the IM Swag Shop are processed by a third-party payment processor. IM does not store your full payment card information on its servers. By providing your payment details, you authorize the applicable third-party processor to charge the payment method provided for the total amount of your order, including applicable taxes and shipping.
10.3 Donations
Charitable donations to Illustrative Mathematics are processed through PayPal. IM is a 501(c)(3) tax-exempt organization; donations may be tax-deductible to the extent permitted by law. IM does not provide tax advice; please consult a qualified tax professional regarding deductibility.
10.4 Returns and Refunds
If you have a question or concern about a Swag Shop order, please contact us at [email protected]. IM will review all inquiries and respond in a timely manner. We reserve the right to authorize returns, exchanges, or refunds on a case-by-case basis at our sole discretion.
10.5 Product Availability and Pricing
All product listings, prices, and availability are subject to change without notice. IM reserves the right to discontinue any product at any time. In the event of a pricing error, IM reserves the right to cancel orders placed at the incorrect price and will notify affected customers.
11. Cookies Policy
11.1 What Are Cookies
Cookies are small text files placed on your device by a web server when you visit a website. They are widely used to make websites function properly, to improve performance, and to provide information to the owners of the site.
11.2 How IM Uses Cookies
The IM Websites use cookies for the following purposes:
- Traffic monitoring: to analyze how visitors use the Websites so we can measure and improve performance
- Bug identification and fixing: to detect and diagnose technical issues that affect the user experience
- Session management: to maintain your logged-in state on pages that require authentication
IM does not use cookies to collect personally identifiable student information and does not sell or share cookie data with third parties for advertising purposes.

12. Content Liability
IM shall not be held responsible for any content that appears on your website or publication that links to or references IM content. You agree to protect and defend IM against all claims arising from content appearing on your website or in materials you produce.
No link or reference to IM content may appear on any website or in any publication that contains content that: (a) is defamatory, obscene, or criminal in nature; (b) infringes any third-party intellectual property rights; (c) otherwise violates applicable law or regulation.
13. Third-Party Links and Resources
The Websites may contain links to third-party websites, resources, or services that are not owned or controlled by IM. IM has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites. We encourage you to review the terms and privacy policies of any third-party websites you visit.
Links to third-party websites do not constitute an endorsement, sponsorship, or recommendation by IM of the linked site, its content, or its operators. IM IS NEITHER RESPONSIBLE NOR LIABLE FOR ANY THIRD-PARTY SERVICES, INCLUDING THE ACCURACY, INTEGRITY, COMPLETENESS, QUALITY, LEGALITY, USEFULNESS, OR SAFETY OF, OR INTELLECTUAL PROPERTY RIGHTS RELATING TO, SUCH THIRD-PARTY SERVICES. 14. Digital Millennium Copyright Act
The Digital Millennium Copyright Act of 1998 (“DMCA”) provides recourse for copyright owners who believe that material appearing on the internet infringes their rights under U.S. copyright law. If you believe that any material residing on or linked to from the Websites infringes your copyright, please send (or have your agent send) to Illustrative Mathematic’s Copyright Agent a notification of claimed infringement with all of the following information: (a) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works; (b) identification of the claimed infringing material and information reasonably sufficient to permit us to locate the material on the Websites (such as the URL(s) of the claimed infringing material); (c) information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an e-mail address; (d) a statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the copyright owner’s agent or the law; (e) a statement by you that the above information in your notification is accurate and a statement by you, made under penalty of perjury, that you are the owner of an exclusive right that is allegedly infringed or are authorized to act on such owner’s behalf; and (f) your physical or electronic signature. 15. Disclaimer of Warranties
THE WEBSITES AND ALL CONTENT, MATERIALS, INFORMATION, PRODUCTS, AND SERVICES PROVIDED THROUGH THE WEBSITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
IM does not warrant that: (a) the Websites will be uninterrupted, error-free, or secure; (b) any defects or errors will be corrected; (c) the Websites or the servers that make them available are free of viruses or other harmful components; or (d) any information or content on the Websites is accurate, reliable, or current.
The curriculum materials provided on the Websites are intended for educational purposes. IM makes no warranty regarding the suitability of the Curriculum for any specific educational objective, student outcome, or accreditation requirement.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ILLUSTRATIVE MATHEMATICS, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE WEBSITES OR ANY CONTENT THEREIN, EVEN IF IM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the extent any liability is found notwithstanding the foregoing, IM’s total cumulative liability to you for any claims arising under these Terms shall not exceed the greater of (a) fifty U.S. dollars ($50.00) or (b) the total amount paid by you to IM in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.
17. Indemnification
You agree to indemnify, defend, and hold harmless Illustrative Mathematics and its officers, directors, employees, volunteers, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Websites; (b) your violation of these Terms; (c) your infringement of any intellectual property or other right of any third party; or (d) any content you submit or transmit through the Websites.
18. Termination
18.1 Termination of Access
IM reserves the right, at its sole discretion and without prior notice, to suspend or terminate your access to all or any part of the Websites for any reason, including if IM believes you have violated these Terms. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.
18.2 Changes or Termination of Websites
IM reserves the right to discontinue any or all of the Websites, or to change any website’s content or functionality, at any time and without notice.
19. Governing Law and Dispute Resolution
19.1 Governing Law
These Terms and any dispute arising out of or related to them or to your use of the Websites shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.
19.2 Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Websites, the parties agree to first attempt in good faith to resolve the matter informally by contacting IM at [email protected].
If the dispute cannot be resolved informally within thirty (30) days, it shall be submitted to binding arbitration administered in Pima County, Arizona, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.
19.3 Venue
For any matters not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Pima County, Arizona.
19.4 Class Action Waiver
To the fullest extent permitted by law, all disputes shall be resolved on an individual basis. You agree not to bring or participate in any class, collective, consolidated, or representative action or proceeding against IM.
20. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed from these Terms. The remaining provisions shall continue in full force and effect.
These Terms, together with the IM Privacy Policy and any additional Terms applicable to specific features or services, constitute the entire agreement between you and IM with respect to your use of the Websites and supersede all prior agreements and understandings, whether oral or written, relating to that subject matter.
21. Waiver
IM’s failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of a breach of these Terms must be in writing and signed by an authorized representative of IM, and shall not be construed as a waiver of any subsequent breach.

Brand Guidelines for Users of IM® Math Open Education Resource Materials
Terms of Use under Fair Use and Creative Commons Licenses
Illustrative Mathematics® and IM® are the registered trademarks and the name of a 501(c)(3) corporation. Our company, Illustrative Mathematics, has created open education resource (OER) materials named IM® K–12 Math. Two editions are in publication with different Creative Commons licenses. The earliest edition, copyright 2019-2021, is called IM® K-12 Math and offered under a Creative Commons Attribution 4.0 International License (CC BY 4.0). The second edition, an IM K-12 Math curricula called IM® v.360, copyright 2024, is offered under a Creative Commons 4.0 Non-Commercial International License (CC BY-NC 4.0).
Use of either Creative Commons license requires an attribution to the source material and license. The Illustrative Mathematics® name and logo are not subject to the Creative Commons license and may not be reproduced without the prior and express written consent of Illustrative Mathematics. Entities who create and sell products based on the first edition, IM K–12 Math (CC BY 4.0), or who create non-commercial products based on IM v.360 (CC BY-NC 4.0), are free to call their product anything they like as long as it does not suggest an association or relationship with Illustrative Mathematics. Our company name, Illustrative Mathematics®, or unauthorized derivatives such as Illustrative Math, may not be used to name our curricula in any context.
In secondary messaging and attribution, it is appropriate to refer to authorship by Illustrative Mathematics, for example: “[Product Name] is based on IM® K–12 Math authored by Illustrative Mathematics®. Used under a CC BY 4.0 license.” Likewise, in secondary messaging and attribution for non-commercial uses of IM v.360 we suggest: “[Product Name] is based on IM® v.360 authored by Illustrative Mathematics®. Used under a CC BY-NC 4.0 license.” Nomenclature of either edition may include a specific grade or grade band as appropriate (e.g., IM® Grade 3 Math, IM® 6-8 Math v.360, etc.). The trademark registration symbol for Illustrative Mathematics® or IM® should be placed in the first or most prominent use of the mark and may be left off of subsequent mentions.
